By using qodaly (“Service”), you accept the outlined terms and conditions (“Service Terms”).

qodaly Ltd (“Company”) may modify these Service Terms without prior announcement.

Failure to adhere to any of the listed terms can result in account deactivation.

Account Responsibilities

  • Ensure the security of your account and password. qodaly will not be held responsible for any losses or damages due to neglect of this responsibility.
  • You are accountable for all content and activity associated with your account, even when generated by others with logins under your account.
  • The Service cannot be used for any illegal activities or any actions that breach laws in your jurisdiction, including copyright laws.
  • You must provide accurate details, including your legal name, valid email, and any other necessary information during registration.
  • Only humans can register accounts. Automated registrations via “bots” are not allowed.

Billing, Refunds, Subscription Changes

  • qodaly might modify subscription prices. You’ll be informed of any price alterations via your registered email and on our website’s billing page.
  • SMS messages beyond the included package will cost £0.04/$0.04/€0.04.
  • Monthly subscription charges will be taken from your payment method after the trial unless you email [email protected] to cancel.
  • Yearly subscriptions offer a 30-day partial refund, adjusted based on usage.
  • Any changes in subscription tier will be billed during the next cycle without prorating.
  • Downgrading might result in feature loss. qodaly is not accountable for such losses.
  • All charges are exclusive of taxes and duties. If needed, qodaly will collect and remit these.
  • Refunds adhere to our equitable refund policy.
  • For customer-initiated chargebacks, qodaly isn’t responsible for the chargeback or any associated fees. Such amounts will be subtracted from daily payouts, and you’ll be promptly informed.
  • A fee of £15/$15/€15 may be levied for each chargeback from your clients, which will be subtracted from payouts.

Cancellation

  • Content becomes inaccessible immediately upon service cancellation. After 30 days, all data, barring financial records, is permanently removed.
  • If you cancel during an ongoing paid month, the cancellation is instant and a prorated refund is provided.
  • qodaly can, at its discretion, suspend or terminate any account. This is primarily for users deliberately causing service disruptions or engaging in illegal activities. You’ll be informed in such cases.

Price & Service Changes

  • Prices can change with a 30-day notice.
  • qodaly won’t be accountable for any adjustments, price changes, or service discontinuations.

Intellectual Property

  • You retain rights over the material you upload.
  • While qodaly doesn’t screen all content, we reserve the right to refuse or remove any content.
  • The Service’s appearance is copyrighted by qodaly Ltd. Permission is required for any reuse or duplication.

General Provisions

  • Any Service enhancements are governed by these Service Terms.
  • The Service is provided “as is”. Support is exclusively through email.
  • Understand that qodaly partners with third parties for essential service components.
  • Service misuse or false association claims with qodaly are prohibited.
  • We can remove content or accounts if deemed unlawful or in violation of these terms.
  • Abuse towards any qodaly member or customer results in immediate account deactivation without refunds.
  • Service transmissions might occur unencrypted across networks and undergo modifications for compatibility.
  • Accounts with unusually high activity might be temporarily disabled.
  • qodaly offers no guarantees about service continuity, security, or error-free operation.
  • qodaly isn’t liable for any damages arising from Service use or inability.
  • Non-enforcement of any term does not imply waiver.
  • These terms supersede any prior agreements.

Data Compliance

  • We comply with ICO data protection.
  • “GDPR” denotes Regulation (EU) 2016/679 of the European Parliament and Council.
  • You’re the Data Controller as per GDPR and should ensure customer data confidentiality.
  • We function as the Data Processor per GDPR, ensuring security during data processing.
  • We store personal details only as long as necessary, retaining only legally required data.
